Two New Cases on Peremptory Challenges

I’m not giving a synopsis on these cases because the peremptory challenge debate is typically fact specific.  These are just two more in the ever growing list to add to your trial notebook.

Felkner v. Jackson, 22 Fla. L. Weekly Fed. S873 (Mar 21, 2011): United States Supreme Court per curiam decision – This is a very short USSCt case so no worries having to read it.

Smith v. State, 36 Fla. L. Weekly S99 (Fla. Mar. 17, 2011): Florida Supreme Court Case with dissent – Good case for all those missing case citations stemming out of  State v. Neil, 457 So.2d 481 (Fla. 1984).
